General Terms and Conditions of Team Game GmbH

§1 Basic Provisions

The following General Terms and Conditions (GTC) apply to all business relationships between Team Game GmbH (hereinafter: Team Game) and its customers (in particular contracts concluded via the website www.team-game.de or by email).

A consumer within the meaning of the following provisions is any natural person who concludes a legal transaction for purposes that cannot be attributed predominantly to their commercial or independent professional activity. An entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent professional or commercial activity.

§2 Conclusion of contract

You can book your desired date via our website https://www.team-game.de/book-now, provided it is still available for the desired number of people.

Our offers are non-binding. By booking the desired date, you are making a binding offer to conclude a contract. We will accept your offer by sending a confirmation email to the email address you provided, after which your binding booking will be confirmed.

By concluding the contract, you agree that your order data, including these terms and conditions, will be stored by us for the purpose of executing the contract.

You can also make booking requests to us by phone, which we will then enter into the system for you. As long as we have not yet booked you using the booking form, they are non-binding. The contract and thus the binding booking only come into effect when you receive a booking confirmation and appointment confirmation. If you do not receive an email confirmation, please contact us again.

§3 Terms of Payment

The purchase price is due immediately upon ordering.

Team Game GmbH reserves the right not to approve participation in the event until all payment claims arising from the contractual relationship have been settled in full.

The purchase price for bookings via the website is due immediately upon ordering, for all other booking transactions at the latest upon receipt of the binding appointment confirmation by email.

The available payment methods can be found on our website https://www.teamgame.de/book-now or are stated in the respective offer.

Payments via credit card, PayPal and SOFORT transfer are partly processed by our partners Stripe and Klarna. You will be redirected accordingly.

§4 Performance

Your confirmed order entitles you and your team(s) to participate in the event and to use the agreed services on the booked date of validity and in the booked period of validity during the agreed period of validity.

To ensure that everything runs smoothly for all participants, all participants must arrive at Team Game approximately 10 minutes before the booked start time. Team Game always starts on the hour. If you are late, the duration or scope of your event will be reduced accordingly, without giving rise to any claims for reimbursement.

§5 Liability

Team Game GmbH is not liable for any damage that occurs before, during or after the event.

All game and puzzle materials required for the tour will be loaned to you and your team(s) by Team Game for the duration of your tour. Team Game does not collect a deposit for this loan, but reserves the right to hold you, the main booker, liable for any damage or loss caused by willful intent, improper use or carelessness by any of the game participants in your group, and to make you pay for the costs incurred. The right of recourse includes in particular all game and puzzle materials and the game case or puzzle backpack, as well as damage to yourself or to the Team Game cargo bike when removing or returning the game and puzzle materials. By booking an event slot with Team Game, you explicitly agree to this procedure. Damage caused by intent or gross negligence on the part of the game participants will also be pursued.

Essential contractual obligations are those whose violation endangers the achievement of the purpose of the contract, whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the customer regularly relies.

§6 Cancellation conditions / cancellation policy

Contracts for the purchase of tickets in connection with leisure activities for which a specific date or period is planned are not subject to the right of cancellation. This means that otherwise there is no two-week right of cancellation and return (Section 312g Paragraph 2 No. 9 of the German Civil Code). Rebooking is only possible in exceptional cases and after prior telephone or personal consultation with the management of Team Game GmbH.

A revocation or cancellation is also not possible if new rules and requirements regarding access requirements in the leisure industry come into force in the future through a general decree. The risk of meeting the personal access requirements lies solely in the personal risk sphere of the customer.

Every consumer has the right to cancel (Section 13 of the German Civil Code). A consumer is any natural person who concludes a legal transaction for private purposes and not in the exercise of their commercial or independent professional activity.

Bad weather guarantee:

Since Team Game always takes place outside and the weather is beyond our control, we offer you the option of rebooking free of charge or a voucher if the weather makes the tour impossible (e.g. persistent rain, storms, heavy snowfall). Please contact us in writing by email or by phone up to 1 hour before your planned game start. With regard to the game tours (city and beer tour), a 100% refund of the ticket price is also possible by arrangement.

You have a legal right of cancellation for contracts for vouchers. You have the right to cancel this contract within fourteen days after purchasing a voucher without giving any reason. The cancellation period is fourteen days from the day the contract is concluded. We will not refund any monetary value for a voucher if the voucher period/redemption period has expired.

by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. To meet the withdrawal period, it is sufficient that you send your notification of exercising your right of withdrawal before the withdrawal period has expired.

Consequences of cancellation: If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund.

§7 Miscellaneous

1. Team Game is entitled to refuse entry to participants or to exclude them from the current event if the person(s) concerned disrupt general business operations due to alcohol or drug consumption or for other reasons or harass other participants or Team Game employees, or if there is at least a legitimate fear that this could happen. In these cases, the entrance fee or voucher value will not be refunded.

2. All disputes arising from or in connection with this agreement shall be governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods.

3. Place of performance and exclusive jurisdiction is (as far as legally permissible) Bamberg.
